$460,000 Recovery for Title Insurance, Bad Faith Claim, Quiet Title and Foreclosure Action

Daley & Heft Partner Scott Noya recovered over $460,000 for a private lender client in settlement of a bad faith action against a national title insurance company and quiet title and foreclosure claims against borrowers and a competing major lender.

Daley & Heft’s client loaned $380,000 secured by a deed of trust on San Diego property. Another lender made a $350,000 loan secured by the same property, with a deed of trust recorded one day later. Borrowers later disputed our client’s loan was valid. Our loan company client filed an action for quiet title, foreclosure and related bad faith and title insurance claims.

In two separate settlements Daley & Heft’s client recovered over $460,000, including attorney fees.
